Equipment Leasing and Financing
Kraemer Burns has substantial experience representing equipment manufacturers and financing companies both in leasing and financing matters. The firm has:
- Developed and drafted client specific documents for use in our clients day-to-day sale and lease transactions.
- Negotiated and drafted the terms of complex agreements involving asset based financing of high dollar and euro value machinery both in the United States and overseas. In transactions involving multiple jurisdictions we work with other Mackell member firms. With Mackrell member firms in approximately 90 jurisdictions, we cover the entire business world for our clients.
- Represented numerous clients with claims and judgments against defaulting borrowers and lessees to enforce the rights of judgment creditors, secured party lenders and equipment lessors. We have successfully obtained judgments and negotiated settlements for clients that have allowed us to obtain possession for our clients of a diverse array of assets that have included mammoth pieces of equipment, involved in the graphic arts industry such as printing presses and die cutting machines, jet aircraft, a jet aircraft engine and a yacht. Through the Mackrell member firms we can proceed against defaulting debtors and lessees in seeking possession of collateral almost anywhere in the world.
- Represented secured party lenders and lessors as creditors in bankruptcy proceedings as well as defending against preference claims.
